Under Regulation 12(1)(b) of the EIR2004, we have considered whether the public interest in disclosing this information outweighs the interest in maintaining the exception.

Factors in favour of disclosure:

  • Promotes transparency and accountability in environmental decision-making.
  • Enhances public understanding of development processes and associated obligations.

Factors in favour of withholding:
  • Disclosure would likely harm the commercial interests of the developer and related parties by revealing sensitive financial and contractual details.
  • Could undermine future negotiations and competitive processes, impacting the authority’s ability to secure best value for the public.


Therefore, the information relating to ‘Bond Value’ and ‘Road & Sewer Designer/Developer’ is being withheld under Regulation 12(5)(e) "Disclosure would adversely affect commercial or industrial confidentiality" of the EIR2004. This regulation applies where disclosure would adversely affect the confidentiality of commercial or industrial information, where such confidentiality is protected by law to safeguard a legitimate economic interest.
