An outline of your compensation scheme, including eligibility criteria and process – Nottinghamshire County Council does not operate a compensation scheme. Claims for compensation relating to highways incidents are dealt with through the civil claims process. Each claim is investigated to determine whether the Council has adhered to its policy and the requirements of the Highways Act 1980, the legal framework in place to deal with the management and operations of the road network in England and Wales. There is no automatic right to compensation, claims will only be settled if the investigation finds evidence of negligence on the part of the Council. Procedurally the claims are handled in accordance with the Civil Procedure Rules 1998.
