Thank you for your request for information relating to the Net Capacity Assessment Report for Alderman White School.
1. Confirmation of whether a site visit to Alderman White School took place under the NCA programme and if so the date of the visit.
Yes, 10/04/2025.
2. A copy of the NCA report produced for Alderman White School, including the capacity range, final net capacity figure and supporting room-level data.
The Council is withholding the requested information under Section 36(2)(c) of the Act (prejudice to the effective conduct of public affairs). Section 36 is a qualified exemption and applies where, in the reasonable opinion of a qualified person, disclosure of the information would, or would be likely to, inhibit the free and frank exchange of views for the purposes of deliberation and/or otherwise prejudice the effective conduct of public affairs.
In this case, the opinion of the Monitoring Officer (NCC"s "qualified person") is that the disclosure of requested information would otherwise prejudice, or would be likely otherwise to prejudice, the effective conduct of public affairs.
In this case, the report contains figures relating to the Department for Education’s net capacity assessment for the school. These figures are currently subject to dispute by the school, and similar assessments have previously been challenged by other schools, with some found to be inaccurate upon review. As such, the data is not yet settled or agreed.
Disclosure of information that is known to be disputed and potentially inaccurate would be likely to:
• Undermine confidence in the assessment process;
• Lead to misinterpretation of provisional data;
• Prejudice ongoing discussions and efforts to resolve and agree a definitive assessment;
• Impact the effective conduct of public affairs by placing incomplete or contested information into the public domain.
Section 36 is a qualified exemption meaning that we must also consider the public interest test.
We recognise that there is a public interest in transparency and openness in relation to school capacity and decision-making. However, in this instance, we consider that the public interest in maintaining the exemption at section 36(2)c outweighs the interest in disclosure. Releasing disputed and potentially inaccurate information before it has been finalised would not serve the public interest as it could lead to confusion as well as potentially undermining trust in the process.
3. If no report has yet been received by NCC, confirmation of when the report is expected.
Not applicable as the report has been received.
4. The net capacity figure for Alderman White School as reported by Nottinghamshire County Council in the 2024-25 SCAP return to the DfE.
NCC reported a net capacity figure of 725 in the 2024-25 SCAP return to the DfE.
