Public Interest Test
Request:
“What schedule of works is now planned to resolve the ever-growing problem and deteriorating section of the A57 between the Sainsbury’s roundabout and the Gateford Road roundabout”
Exemption considered:
Section 22(1) – Information intended for future publication.
Factors in Favour of Disclosure
Promoting transparency and accountability
There is a legitimate public interest in understanding how Nottinghamshire County Council plans and prioritises highways maintenance, particularly regarding a known deteriorating section of the A57.Public safety and reassurance
Road users, residents, and local businesses *****be directly affected by the condition of the A57. Disclosure could help them understand what steps are being taken to manage safety risks and plan for future disruption.Enhancing public confidence
Sharing information early can demonstrate that the authority is actively managing the issue and help maintain public trust in decision-making around highways investment.
Factors in Favour of Maintaining the Exemption
Information is not yet final and *****be misleading
The capital programme for 2026–27 has not yet been finalised, approved, or published. Premature disclosure could mislead the public if the details later change during the formal approval process.Ensuring orderly publication
The Council has a planned and established publication process, which ensures accuracy, proper context, and fairness to all stakeholders. Releasing draft information ahead of this process could undermine the integrity of the programme’s approval and publication cycle.Protecting effective decision-making
Officers and Members require space to complete internal reviews, costings, and prioritisation without external pressure that might distort deliberations. Releasing incomplete information could hinder this process.Imminent publication
The capital programme is expected to be completed and published in the near future. Because the information will be available soon, the public benefit in early disclosure is reduced.
Public Interest Test Conclusion
While there is a clear public interest in understanding planned works on the A57 due to safety concerns and the road’s deteriorating condition, the balance of public interest currently favours maintaining the exemption under Section 22.
This is because the information is still being finalised, *****change before approval, and is scheduled for publication in the near future through the Council’s formal process. Premature disclosure could mislead the public and disrupt orderly decision-making.
However, this exemption applies only to the schedule of future works.
In line with transparency and safety obligations, the Council has confirmed that:
- The A57 will continue to be inspected in accordance with its scheduled frequency.
- Any defects meeting intervention criteria will be repaired as required.
