FREEDOM OF INFORMATION ACT 2000 – REQUEST FOR INFORMATION REFERENCE FOI/8652

Thank you for your request for information relating to Planned Health and Social Care Commissioning Pipeline.

We are now able to provide the following information:

The Council holds some information relevant to your request in published sources which are reasonably accessible to you. This information is therefore exempt from disclosure under Section 21 of the Freedom of Information Act 2000 (Information Accessible by Other Means).

The Council publishes its forward procurement pipeline, which includes information on contracts expected to be procured or re-procured over the coming period. This can be accessed here: Procurement Pipeline | Nottinghamshire County Council

In addition, under the Procurement Act, the Council publishes Pipeline Notices on the Find a Tender service. These notices contain information such as:

  • Procurement title and reference;
  • Contract subject matter;
  • Estimated publication date of the procurement notice;
  • Contract location; and
  • In some cases, contract value and sourcing method.
These notices can be accessed via the Find a Tender service by searching for Pipeline Notices issued by Nottinghamshire County Council.

However, the published information does not contain all of the specific information requested. In particular, information such as:
  • The anticipated procurement route;
  • Publication dates for market engagement activity;
  • Contract terms and extension options;
  • Details of planned market engagement events, provider information sessions or pre-procurement consultation activity; and
  • Other future commissioning information not currently published,

is not held in a single recorded source.

To determine whether such information is held and to identify, extract and collate any relevant information, the Council would need to review approximately 120 individual pipeline records and consult a number of separate systems and sources. The Procurement Team estimates that this exercise would take in excess of 20 hours.
Section 12(1) of the Freedom of Information Act 2000 provides that a public authority is not obliged to comply with a request if it estimates that the cost of determining whether the information is held, locating, retrieving and extracting the information would exceed the appropriate limit. For local authorities, the appropriate limit is £450, equivalent to 18 hours of work at the prescribed rate of £25 per hour.

The Council therefore refuses this part of your request under Section 12(1) of the Freedom of Information Act 2000, as complying with the request would exceed the appropriate cost limit.
Under our duty to provide advice and assistance pursuant to Section 16 of the Act, we would direct you to the published Procurement Pipeline and the Find a Tender Pipeline Notices, which provide the majority of the information currently available regarding planned procurement activity.
