FREEDOM OF INFORMATION ACT 2000 – REQUEST FOR INFORMATION REFERENCE FOI/7516

Thank you for your request for information relating to FOI re: SEND Tribunals.

We are now able to provide the following information:

1.How many SEND/ EHCP appeals were made in 24/25 and in 25/26 so far-

For the 2024/25 academic year- 201
For the 2025/26 academic year so far- 140


2. a) How many of these were resolved through mediation

For the 2024/25 academic year- 99 were resolved as they were overturned
For the 2025/26 academic year so far- 53 are still live, 48 so far overturned

     
2. b) How many of those resolved through mediation found in favour of the Local Authority vs in favour of the child/ young person/ child"s representative All overturned decisions were in favour of parent/ young person


2024/2025- all overturned decisions were in favour of parent/young person
2025/26- all overturned decisions were in favour of parent/young person


3. How many appeals were registered with the tribunal service in 24/25 and in 25/26 so far

For the 2024/25 academic year- 184
For the 2025/26 academic year so far- 125


4. How many of the appeals in question 3, were conceded by the local authority prior to a tribunal

For the 2024/25 academic year- 124 were overturned prior to tribunal
For the 2025/26 academic year so far- 48 overturned prior to tribunal so far


5. How many of the question 3 appeals that continued through to a tribunal, were found in favour of the local authority vs in favour of the child/ young person/ child"s representative

For the 2024/25 academic year- From the 184, 30 are still live currently, 5 were withdrawn or dismissed, 124 were overturned prior to tribunal,  1 was in favour of the LA and 24 were in favour of parent/young person

For the 2025/26 academic year so far- From the 125, 74 are still live,2 have been withdrawn, 1 has moved out of county and 48 were overturned prior to tribunal
