complaints for blocked/obstructed rights of way (FOI/6102)
Message from Nottinghamshire County Council - 04 August 2025
Dear Requester,
Request FOI/6102
Further to your request received I confirm that the Council has now considered your request under the Freedom of Information Act 2000.
We would like to make a freedom of information request.
How many complaints for blocked/obstructed rights of way has your authority received for each year for the previous 6 years No information
Of these how many required a) no action b )informal advice or discussion with the relevant land manager c) formal enforcement action and d) are waiting longer than 12 months No information
How many individual obstructions were recorded as requiring action for each year for the previous 6 years No information
How much has your authority spent on roadside ditch clearance in each year for the previous 6 years
There is no specified budget for roadside ditch clearance. The majority of roadside ditches are privately maintainable by adjacent land/property owners as riparian owners of the watercourse. The Highway Authority is only responsible for clearance of roadside ditches where they are either the riparian owner, or where the ditch is in situ purely for the purposed of draining the highway. These can be considered highway ditches.
Highway ditches are cleared on a reactive basis and are often cleared as part of a wider scheme of works. All highway drainage works are prioritised using a risk-based approach. Incoming flooding/blocked drain enquiries are inspected and prioritised based on the impact the reported issue is having on the Highway and its extent; the nature of the road, the speed and volume of traffic/use and the impact on property and land.
In view of this, we are unable to give an accurate figure of how much has been spent on roadside ditch clearance in each of the last 6 years.
How much has your authority spent on contributions to landowners for replacement furniture on public rights of way under S146 No information
How many times have you Used the S154 duty to require the landowner to pay for works and how much have you recouped for each year for the previous six years. No information
How many live complaints remain to be resolved for each year for the previous 6 years No information
How much has your authority spent on roadside ditch clearance in each year for the previous 6 years As above
What is your total annual budget for the public rights of way network, £250k revenue plus specific schemes from ITM funding
Within this what is the estimated expenditure on a) improvement to public rights of way b) enforcement work and c) DMMO work per annum, as above
We hope you find this information useful.
