SEND data (FOI/7802)
Message from Nottinghamshire County Council - 14 May 2026
Dear *********
FREEDOM OF INFORMATION ACT 2000 – REQUEST FOR INFORMATION REFERENCE FOI/7802.
Thank you for your request for information relating to SEND data.
To clarify and contextualise the information provided, I would be grateful if you could supply the following for the period from 1 May 2025 to present:
EHCP Timelines
1. The total number of EHCPs issued.
929
2. Of those, how many were completed within the statutory 20-week timeframe.
297
3. The longest time taken (in weeks) to issue an EHCP.
39 weeks
Children Awaiting SEND Placement
4. Of the 438 children currently awaiting a SEND placement, how many are:
- receiving no formal education provision
4 (four)
- receiving fewer than 10 hours of education per week.
The Council is exempt from providing this information under s12 of the Freedom of Information Act 2000 on the grounds that to do so would exceed the cost limit of £450. We do not hold this information in an automatically retrievable format and so would have to manually review the records of each child. At three minutes per record (a conservative estimate) it would take 21.9 hours to retrieve the information (3 x 438 (/60)). At a cost of £25 per hour (as set out in the Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004) this would amount to £547.50. In claiming this exemption we are obliged to consider what advice and assistance can be provided to help you reframe or refocus your request to bring it within the cost limit. in this case it is difficult to provide such advice, given that any narrowing will not provide the full picture. However you might consider asking for information from a small number of records selected for example at random or by date range. Should you choose to narrow the scope of this question please bear in mind that our time estimate is a conservative one and your refined question will be treated as a new Freedom of Information request.
5. The longest recorded waiting time for a SEND placement
2 years
Tribunal Outcomes
6. Of the SEND tribunal cases concluded in this period, please confirm:
- the number decided in favour of the council (if any).
0 (none)
7. The number of cases where the council conceded or agreed to changes prior to a full hearing.
106 concluded/overturned.
("Concluded" means the case exceeded the deadline date, but we were given consent by the person who submitted the case to conclude it in their favour. "Overturned" means the case was overturned in favour of the person who submitted the case prior to the deadline.)
We trust this now satisfies your request and that you find this information to be helpful.
If you are dissatisfied with the handling of your request, you have the right to ask for an internal review.
