- Whether cost of provision is considered by panels prior to determining suitability of provision-
When panels consider the suitability of educational provision for a child or young person with an EHC plan, the primary and overriding consideration is always the child or young person’s special educational needs and the provision required to meet those needs. Decisions are made in accordance with the statutory framework set out in the Children and Families Act 2014 and the SEND Code of Practice.
Cost is not a determining factor when assessing whether a particular placement or provision can meet need. Panels focus first on identifying provision that can meet the child or young person"s needs. However, where more than one provider or placement is identified as able to meet need equally, the panel may then consider cost as one factor within the decision-making process. This approach is consistent with the local authority’s obligation to ensure the efficient use of public resources while still complying with statutory duties.
