REQUEST
Thank you for your request for information relating to the Terms and Conditions of Deposit of Probate Records.
Please treat this as a new request under the Freedom of Information Act 2000, although the nature of the information requested relates to a previous request, reference FOI/6357.
Firstly, thank you for your response FOI/6357, which is most useful.
This request refers to the PDF document supplied in response to FOI/6357 which can be found at the following link: https://www.*****/request/records_deposited_from_district_26#incoming-3153803. Page 24 of the aforementioned PDF file refers to "conditions attached” where it states:
"As depositor of the records scheduled above, I agree to abide by the conditions attached.”
Also, on page 25 of the aforementioned PDF, there is a reference to "terms and conditions” where it states:
"Formal acceptance by the Council of any records will not come into force until the terms and conditions have been confirmed in writing by both the Council and the owner.”
I assume that "the conditions attached” and "terms and conditions” refer to the same document. Please therefore provide me with the following information:
a) The terms and conditions that were in use in November 2011.
I understand that the Depositor would have retained the ‘attached" conditions, but it is reasonable to assume that Nottinghamshire Archives have a copy of the terms and conditions that were in use in 2011.
b) The written confirmation from the Depositor and Council that the terms and conditions were accepted.
If records are held by contractors on your behalf, please confirm whether they are subject to FOI and how responses would be coordinated. For any refusal or redactions, please cite relevant exemptions and internal review procedures.
CLARIFICATION
I write further to my request, reference FOI/6451.
I have since realised that I have already been provided with the written confirmation from the Depositor that the terms and conditions were accepted. This is in fact on the bottom of page 25 of the PDF file supplied in response to FOI/6357. The Depositor signs to agree to the terms and conditions. This information had been requested under b) of my request, copied here:
b) The written confirmation from the Depositor and Council that the terms and conditions were accepted.
I note that is is possible that the written confirmation from the Council that the terms and conditions were accepted may also be on the same form, where the form is signed by Team Manager Archives and Local Studies.
If there is any additional written confirmations from either the Depositor or the Council that the terms and conditions were accepted, please provide these, otherwise I am satisfied that the written confirmations have already been received.
RESPONSE
With regard to (a) please find attached the terms and conditions in force in 2011.
With regard to (b) we do not hold any additional information.
